These Terms of Use (“ToU”) constitute a legal agreement between you (“you,” “your,” or “user”) and DesignMySpace Inc. (“DMS”), governing your access to and use of the services provided by DMS, including but not limited to the website (designmyspace.co), social media platforms, digital content, and both online and in-person interior design and project management services (collectively, the “Services”).

1. Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by this ToU and the Privacy Policy of DMS. If you do not agree, you must not use the Services.

2. Who Can Use the Services

Users must be at least 18 years old (or the age of majority in their jurisdiction) to use the Services. By accessing the Services, users represent and warrant that they meet this requirement.

3. Intellectual Property

All content associated with the Services—including logos, images, text, layouts, designs, drawings, and project photos—is the exclusive property of DMS or used under appropriate licensing. Users may not copy, reproduce, distribute, modify, or republish any content without prior written consent from DMS.

DMS retains all intellectual property rights to any and all designs, drawings, layouts, renderings, and visuals created for clients. Clients receive the right to use such work solely for their own personal or business space unless otherwise agreed in writing.

4. User Content and Publicity Rights

If users publicly post a review, tag DMS on social media, or share a testimonial, users grant DMS the right to repost or use such content for marketing and promotional purposes without further approval or compensation.

5. Third-Party Services

The Services may link to third-party websites or platforms. DMS does not control those platforms and is not responsible for their content, policies, or practices.

6. In-Person and Virtual Services

DMS offers both in-person and virtual (online) interior design and project management services:

• In-person services are available throughout Brampton, the Greater Toronto Area (GTA), and select locations in Canada and the United States, subject to scheduling, project scope, and location.
   
• Virtual services (eDesign) are available to clients across Canada and the U.S., providing remote collaboration through digital tools, virtual meetings, and customized deliverables.
   

Service availability depends on project nature, location, and DMS’s scheduling. DMS reserves the right to determine the most appropriate method of service delivery.

7. Disclaimer and Limitation of Liability

The Services, including online components, are provided “as is.” DMS makes no guarantees that the Services will be uninterrupted or error-free. DMS disclaims all liability for any loss, damage, or inconvenience arising from user’s use of the Services. Liability shall not exceed one Canadian dollar (CAD $1.00).

8. Indemnification

Users agree to indemnify and hold harmless DMS, its employees, and affiliates from any claims, losses, or damages (including legal fees) arising from user’s violation of these terms or misuse of the Services.

9. Changes to the Terms of Use

DMS may update these Terms at any time. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Services constitutes acceptance of updated terms.

10. Governing Law

These Terms are governed by the laws of Ontario, Canada. All disputes shall be resolved in the jurisdiction of Ontario.

DesignMySpace Inc. (“DMS”) is committed to protecting your privacy and handling your personal information with care. This Privacy Policy explains how DMS collects, uses, and protects your data when you visit designmyspace.co (“Site”) or engage with DMS’s services.

1. Information We Collect

2. Use of Project Photos and Content

DesignMySpace Inc. (“DMS”) may document selected projects through before-and-after images, progress photos, and final photography for use in our portfolio, website, social media, and other marketing materials. All photos captured during the course of a project are the exclusive property of DMS.

All design work completed by Dalia—whether independently or in collaboration—is the creative and intellectual property of DMS. This includes, but is not limited to, design concepts, renderings, drawings, and completed interiors.

No individual, client, or third party may reproduce, reuse, republish, or distribute any project photography or design work, in part or in full, without prior written consent from DMS.
 

3. How We Use Your Information

• To provide and improve DMS’s services. 
• To communicate with clients and respond to inquiries. 
• To share project outcomes (with permission). 
• To send newsletters or promotional materials (only if opted in). 
• To fulfill legal obligations and business operations.
   

4. Ownership of Work

All designs, layouts, floorplans, drawings, and visual content created by DMS remain the intellectual property of DMS. Clients receive rights to use the design for their space but do not have ownership or redistribution rights unless otherwise agreed in writing.

5. Cookies & Tracking

The Site uses cookies to enhance user experience and analyze traffic. Users may adjust browser settings to manage or block cookies, though this may limit site functionality.

6. Data Sharing and Security

DMS does not sell or rent personal data. Information may be shared with trusted service providers or legal authorities when required. Standard security measures are implemented, though absolute security over the internet cannot be guaranteed.

7. Updates

This Privacy Policy may be updated as needed. Updates will be posted on the Site with a revised effective date.
